Right to performance bonus of an employee on family leave (Statement by the Ombudsman for Equality, TAS 642/2022, issued on 20 June 2023)
The statutory duties of the Ombudsman for Equality include the supervision of the prohibition of discrimination in the Equality Act, and the ombudsman has issued a statement regarding the system of performance bonuses that was found discriminatory, in the case TAS/518/2020, in November, 2021.
The tasks of the Ombudsman for Equality also include provision of information on the legislation on equality and its application. The Ombudsman for Equality has therefore submitted a statement with regard to questions submitted to the ombudsman on the interpretation of decision TAS/518/2020, considering the impacts of the family leave reform that entered into force on 1 August 2022 on the right to performance bonuses and the Ombudsman for Equality's statement on relevant legal effects.
