Student selections
The Equality Act prohibits treating a person less favourably than others in student selections on the basis of gender, gender identity, gender expression, pregnancy or childbirth. In regards to student selections it is therefore prohibited to ask a person who is applying for a place of study about pregnancy, plans to start a family or family responsibilities.
When selecting students the educational institution must only process information which is directly necessary for the studies and the student selection. Necessary information is mainly the kind of information which demonstrates how qualified and suitable the applicant is.
Apart from educational institutions, the prohibition of discrimination in the Equality Act also applies to all persons or parties who are involved in the student selection process. Education and training providers and educational institutions must make sure that those who take part in the student selections have sufficient knowledge of the Equality Act and its effect in the selection process.
